Terms of Service

1. Acceptance of Terms
By creating an account, accessing, or using the Hirebix platform (the "Service"), you agree to be bound by these Terms of Service (the "Terms"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
These Terms constitute a legally binding agreement between you and UIBix Technologies ("Hirebix," "we," "us," or "our"). They incorporate our Privacy Policy by reference.
If you do not agree to these Terms, you must not use the Service.
2. Definitions
- "Service" means the Hirebix AI-powered resume screening and ranking platform, including all features, APIs, and related services.
- "User" means any individual who creates an account on Hirebix (administrators, recruiters, hiring managers, or viewers).
- "Organization" means the company, firm, or entity that subscribes to Hirebix through a User.
- "Candidate" means any natural person whose resume or personal data is uploaded to or processed by the Service.
- "Content" means all data uploaded to or generated by the Service, including job postings, resumes, screening results, notes, and reports.
- "AI Features" means all artificial intelligence and machine learning features of the Service, including screening, scoring, ranking, profile enrichment, and criteria extraction.
3. Account Registration & Security
- You must provide accurate, current, and complete registration information.
- You are responsible for maintaining the security of your account credentials.
- You must immediately notify us of any unauthorized use of your account.
- Organization administrators are responsible for managing access and permissions for team members within their organization.
- One account per person. Shared or generic accounts are not permitted.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. AI Features & Disclaimer
Hirebix provides AI-assisted screening as a decision-support tool. The following important disclaimers apply:
- AI outputs are recommendations, not decisions. Users are solely responsible for all employment and hiring decisions. AI screening scores should never be the sole basis for hiring, rejecting, or otherwise making employment decisions about any individual.
- No guarantee of accuracy. AI models may produce inaccurate, biased, incomplete, or outdated results. Hirebix does not guarantee the accuracy, reliability, or completeness of any AI-generated output.
- Third-party AI models. AI features are powered by third-party language models. Their outputs are subject to the capabilities and limitations of those models.
- Human review required. Users must exercise independent judgment and human review when using AI screening results. In jurisdictions where automated decision-making in employment is regulated (including under the EU AI Act and GDPR Article 22), Users acknowledge their obligations as deployers of AI systems.
- No employment relationship. Hirebix is a tool used by employers and recruiters. Hirebix is not an employer, employment agency, or recruiter, and does not make employment decisions.
5. User Obligations
By using the Service, you agree to:
A. Compliance with Laws
- Comply with all applicable employment laws, anti-discrimination laws, and data protection regulations in your jurisdiction.
- Not use the Service to discriminate against candidates based on race, gender, age, religion, disability, sexual orientation, or any other protected characteristic.
- Ensure that your use of AI screening complies with any local requirements for automated employment decision tools (e.g., NYC Local Law 144, EU AI Act).
B. Candidate Data Responsibilities
- You warrant that you have lawful authority to upload candidate resumes and personal data to Hirebix, including appropriate consent or other legal basis under applicable data protection laws.
- You warrant that you will inform candidates about AI processing of their data, or that you have another lawful basis for such processing.
- You are responsible for responding to candidate requests for data access, correction, or deletion. Hirebix will assist upon request.
- You must not upload data of individuals you know to be under 18 years of age.
C. Prohibited Uses
- Using AI screening scores as the sole basis for employment decisions
- Uploading malicious files, viruses, or harmful code
- Attempting to reverse-engineer, decompile, or extract AI model weights
- Scraping, bulk downloading, or programmatically extracting data from Hirebix
- Sharing account credentials with unauthorized individuals
- Using the Service for any purpose unrelated to recruitment and hiring
- Circumventing security measures, rate limits, or access controls
6. Data Ownership & Content
- Your Content: You retain ownership of all Content you upload to Hirebix, including job postings, resumes, and notes. You grant Hirebix a limited license to process, store, and display this Content solely for the purpose of providing the Service.
- AI-Generated Content: Screening scores, recommendations, candidate summaries, and other AI-generated outputs are produced using your Content and are provided to you as part of the Service. You may use these outputs for your recruitment purposes.
- Organization Data Isolation:Your organization's data is strictly isolated from other organizations. No cross-tenant data access is permitted.
- Data Export: You may export your data at any time in CSV or JSON format. Upon account deletion, we will provide a data export upon request.
7. Service Availability
- We strive to maintain high availability but do not guarantee uninterrupted access.
- We may perform scheduled maintenance with reasonable advance notice.
- We may modify, update, or discontinue features of the Service with notice. We will not remove core functionality without providing a reasonable migration period.
- AI features depend on third-party model providers and may be temporarily unavailable if those providers experience outages.
8. Fees & Payment
- Pricing details are available on our website. We reserve the right to modify pricing with 30 days advance notice.
- Payments are processed securely through third-party payment processors (Stripe).
- Subscription fees are billed in advance on a monthly or annual basis.
- We may offer a free tier with limited features. Usage beyond free tier limits requires a paid subscription.
- Refunds are handled in accordance with our refund policy and applicable consumer protection laws.
9. Intellectual Property
- The Hirebix platform, including its design, code, algorithms, and brand, is the intellectual property of UIBix Technologies.
- You may not copy, modify, distribute, or create derivative works based on the Service without our written consent.
- "Hirebix" and associated logos are trademarks of UIBix Technologies. You may not use these marks without permission.
10. Limitation of Liability
To the maximum extent permitted by applicable law:
- Hirebix is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory.
- We do not warrant that AI screening results are accurate, complete, unbiased, or suitable for any particular purpose.
- We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
- Our total aggregate liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
- We are not liable for any employment decisions made by Users based on AI screening results. Users bear sole responsibility for their hiring decisions.
11. Indemnification
You agree to indemnify and hold harmless UIBix Technologies, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:
- Your use of the Service in violation of these Terms
- Employment decisions made using AI screening results without adequate human review
- Uploading candidate data without proper authorization or legal basis
- Violation of applicable employment or data protection laws
12. Termination
- You may terminate your account at any time from the Settings page.
- We may suspend or terminate your account for violations of these Terms, with notice except in cases of severe violation (fraud, security threats).
- Upon termination, you may request a data export within 30 days. After 30 days, your data will be permanently deleted.
- Sections that by their nature should survive termination (limitation of liability, indemnification, intellectual property, governing law) shall survive.
13. Governing Law & Disputes
- These Terms are governed by and construed in accordance with the laws of India.
- Any disputes shall first be attempted to be resolved through good-faith negotiation for a period of 30 days.
- If unresolved, disputes shall be subject to binding arbitration under the Arbitration and Conciliation Act, 1996 (India), with the seat of arbitration in New Delhi.
- For users in the European Union, nothing in these Terms limits your rights under applicable consumer protection laws or your right to file a complaint with your local data protection authority.
14. Changes to These Terms
We may update these Terms from time to time. We will notify registered users of material changes via email or an in-app notice at least 30 days before the changes take effect. Continued use of the Service after the effective date of changes constitutes acceptance of the revised Terms.
15. General Provisions
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Hirebix.
- No waiver: Failure to enforce any provision of these Terms does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under these Terms. Hirebix may assign its rights in connection with a merger, acquisition, or sale of assets.
